At mymuse.com, a website operated by Artist Tribe, LLC ("myMuse"), we are committed to respecting people's privacy online. We are also committed to providing you with the very best experience we can on our website. In order to do so, we may gather certain personal information about you. Please read the following policy to understand how your personal information will be treated as you make full use of our website and services. By using mymuse.com, you consent to the collection and use of your information by myMuse as described in this Policy, and you signify your agreement to the myMuse Privacy Policy.
Your myMuse page
Information, pictures and media files you upload to your myMuse profile ("Profile Content") will be posted on your myMuse member page, subject to our Users Terms and Conditions, and accessible by all visitors to the site (unless you expressly restrict such access through your account settings). myMuse has no control over, and shall incur no responsibility for, how such visitors will use such Profile Content. Some Profile Content, such as your profile picture and user name, will be displayed without restriction irrespective of your account settings. myMuse reserves the right to remove or edit Profile Content, but does not regularly review such Content.
To facilitate searching and finding friends and acquaintances on the service, myMuse may allow users to search for other members using first and last name, email address, and schools or companies users may have attended or worked at.
myMuse members can invite friends to join myMuse by sending invitation emails via our automated invitation system. myMuse stores the email addresses that you provide so that the respondents may be added to your network, and also to send reminders of the invitations.
Personal Connections profile
The profile you create as part of the myMuse Personal Connections service ("Connection Profile") is available for other Personal Connections members to view. Connection Profiles include a personal description, photos, likes and dislikes, individual essays, and other information helpful in determining matches. Your Connection Profile should not include any contact information, except the username you chose upon registering. Please note that images posted on your Connection Profile can be used by myMuse in ads or press releases about the myMuse Personal Connections service.
myMuse Jobs
You can upload your resume to the myMuse job database with various privacy options:
1. You may set your resume to "private" so that it is not searchable by potential employers. Not allowing your resume to be searchable means that you can use it to apply for a job through myMuse Jobs, but employers and recruiters will not have access to it through our resume database.
2. You may set up your resume so that it is searchable but anonymous. All parties with access to our resume database will have access to it, but only employers to whom you send your resume will be able to view your contact information.
3. You may set up your resume to be searchable and include your contact information. All parties with access to our resume database will have access to your resume and contact information.
We attempt to limit access to our resume database to paying employers, recruiters, hiring managers, headhunters, and human resource professionals, as well as law enforcement and national security agencies, but cannot guarantee that other parties will not gain access to this database. In addition, portions of your resume (but not your contact information) may be made public in your myMuse page.
Publicly available information
Please remember that if you post any of your personal information in publicly accessible areas of the site, including your myMuse page, such information may be collected and used by others over whom we have no control. We are not responsible for the use made by third parties of information you post or otherwise make publicly available.
What information does myMuse collect?
When you visit mymuse.com, we collect some basic usage information that does not personally identify you. We then aggregate this information with other pieces of information to improve our site and make your experience on the site as valuable and efficient as possible.
When you register for mymuse.com services, we collect personal information such as name, age, address, phone, email, occupation, skills, payment and billing information in order to set up your account.
In addition to the information we collect upon your initial registration with mymuse.com, we may ask you for personal information at other times, including, but not limited to, when you enter promotions or contests, and when you respond to a survey.
Upon cancelling your myMuse account, you have the right to request deletion of your account information, subject to our need to keep appropriate archives for our business operations.
What do we do with the information we collect?
1. It is used to set up and maintain your myMuse account and to fulfill any orders.
2. We provide you with information about your subscriptions and orders (such as whether your order has been received, processed, or shipped). We save the information about services you subscribe to and products you purchased to provide you with the best possible customer service and the most up-to-date information.
3. If you provide it, your phone number may be used in the event that our customer service representatives need to contact you and cannot reach you by email. If you provide your mobile phone information, we may use such information to communicate with you regarding mymuse.com by SMS, MMS, text message or other electronic means to a mobile device.
4. Credit card information is used to bill you for services and products you have ordered and to track subscriptions and sales.
5. Based on the occupation listed in your registration form, tags and sub-tags associated with the corresponding myMuse community will be attached to your myMuse profile to facilitate networking and maximize your account functionality.
6. Your email address and other personal information will never be sold to any other website owner or merchant. We hate junk mail as much as you. This is why we will only send you emails about items that we feel you should know about. This includes special promotional items that myMuse endorses, membership changes, terms and conditions changes, Holiday cards, and the latest happenings on mymuse.com. When we send emails that include a link to the myMuse site, that link may contain an alphanumeric identifier that allows us to identify the person to whom we sent the message so that we can personalize our content for that individual.
Email opt-out
If you no longer wish to receive our email updates or other notifications, you may opt out of receiving these communications by following the instructions contained in the applicable email or by logging in and changing your account settings.
Credit card processing
Credit card transactions are handled by a third-party processor that receives credit card numbers and other personally identifying information only to verify credit card accounts and process transactions. If you feel more comfortable doing so, you are welcome to pay by check through the mail.
Credit card security is an important aspect of the online experience. We use encryption technology to keep your credit card information safe. To ensure that your information is even more secure, once we receive your credit card information, it is stored on a server that isn't accessible from the Internet.
With whom do we share your information and for what purpose?
myMuse does not sell, rent, or trade any personally identifying user information with third parties. However, when one or more of our business partners co-sponsor a service, promotion or contest, we may share some or all of the information collected in connection with such service, promotion or contest with the co-sponsor(s). If we intend to share such information, you will be notified prior to its collection. If you do not want your information to be shared, you will be able to choose not to allow the transfer by not using or signing up for the particular service, promotion or contest.
We may also share aggregate user information in a non-personally identifiable manner with advertisers and other third parties in order to present to users more targeted advertising, products and services. Without limiting the generality of the foregoing, your myMuse profile tags will be shared with our website advertisers, in aggregate form only, to allow them to target their ads to myMuse member pages that belong to relevant myMuse communities.
We may contract with third parties to conduct research and marketing on our behalf. Such third parties will be fully bound by an obligation of confidentiality to myMuse and may not use any personally identifying user information provided by us other than as expressly instructed by us and in strict compliance with the terms of this Privacy Policy.
For the purposes of effecting payment or servicing your account, we may share with third parties, such as payment processors, any payment information that you provide.
What information do parties other than myMuse collect?
Some entities that have links on our site may collect personally identifying information about you when you access or utilize those links. myMuse does not control the collection or use of such information, and the practices of those entities are not covered by this Privacy Policy.
What are "cookies" and how do we use them?
Our site may use "cookies" to speed navigation, keep track of items, and provide you with custom-tailored services.We also use "cookies" to remember information you gave us so you don't have to re-enter it each time you visit the site. By showing us how and when visitors use the site, "cookies" help us see which site areas and content are popular. We also collect IP addresses for system administration and to report aggregate information to any sponsors. Some advertisers or websites that have links on our site may also use their own "cookies."
Most browsers are initially set to accept "cookies." If you prefer, you can set yours to refuse "cookies." You will not be able to use many of our features if you turn off the "cookies" option.
Security
myMuse member accounts are secured by member-created passwords. In addition, we use reasonable measures to protect member information that is stored within our database, and we restrict access to member information to those employees who need access to perform their job functions, such as our customer service personnel and technical staff. However, please note that we cannot guarantee the security of member account information. Unauthorized entry or use, hardware or software failure, and other factors may compromise the security of our member information at any time.
Business transitions
In the event myMuse goes through a business transition, such as a merger, acquisition by another company, or sale of a portion of its assets, users' personal information will, in most instances, be part of the assets transferred.
California User Consumer Rights
In accordance with California Civil Code Sec. 1789.3, California resident users are entitled to know that they may file grievances and complaints with California Department of Consumer Affairs, 400 R Street, STE1080, Sacramento, CA 95814; or by phone at 916-445-1254 or 800-952-5210; or by email to dca@dca.ca.gov.Under California law, California residents who have an established business relationship with us or one of our subsidiaries may choose to opt out of disclosure of personal information about them to third parties for direct marketing purposes. As detailed above, our policy is not to disclose personal information collected online to a third party for direct marketing purposes without your approval. If you choose to opt-out at any time after granting approval, email privacy@mymuse.com.
Users located outside of the United States
We make an effort to protect the personal information of all myMuse users. If you are unsure whether this privacy policy is in conflict with the rules applicable where you are located, you should not submit your personal information to myMuse. IN ADDITION, IF YOU ARE LOCATED WITHIN THE EUROPEAN UNION, YOU SHOULD NOTE THAT YOUR INFORMATION WILL BE TRANSFERRED TO THE UNITED STATES, THE LAWS OF WHICH MAY BE DEEMED BY THE EUROPEAN UNION TO HAVE INADEQUATE DATA PROTECTION. myMuse users located in countries outside of the United States who submit personal information do thereby consent to the transfer of that information to, and storage of the information in, the United States.
Cooperation with law enforcement; fraud protection
myMuse fully cooperates with law enforcement agencies in identifying those who use our services for illegal activities. We reserve the right to disclose information about members who we believe are in violation of applicable laws or regulations, or as required to respond to a subpoena, court orders or other legal process requiring such disclosure. We also reserve the right to report to law enforcement agencies any activities that we reasonably believe to be unlawful, and to exchange information with other companies and organizations for fraud protection purposes.
Changes to our Privacy Policy
Use of information we collect is subject to the Privacy Policy in effect at the time such information is used or collected. From time to time, we may change our Privacy Policy and will notify you of those changes by email or post a notice to mymuse.com. Users are bound by any changes to the Privacy Policy when they use the myMuse services after such changes have been first posted. Please note that if you opt out of receiving legal notices from us, those legal notices will still govern your use of the myMuse services, and you are responsible for reviewing changes on the site.
